Terms and Conditions
These Terms and Conditions govern all Double Play Baseball Tours, tour packages sold by Double Play Baseball Tours, LLC. The terms "we," "us" and "our" refer to Double Play Tours, and the term "you" or "your" refers to the customer purchasing a tour package or otherwise using our services to purchase a tour package. By booking and making a deposit, you are agreeing to be bound by these Terms. You agree that any violation of these Terms may result in (a) the cancellation of your tour package, (b) your forfeiture of any monies paid for your tour package, (c) you being denied access to any of the products or services included in your tour package, and (d) our right to charge you for any costs we incur as a result of such violation. You represent and warrant that (i) you are the legal age of majority in your jurisdiction and can create binding legal obligations, (ii) you are legally authorized to act on behalf of all persons for whom you are purchasing a tour package (each, a member of your “Traveling Party"), to grant the waivers and releases set forth below on their behalf, and to accept these Terms on their behalf, and (iii) the information supplied by you is true and correct. You are responsible for informing each member of your Traveling Party of all terms and conditions applicable to their tour package arrangements, including, without limitation, furnishing a copy of these Terms to each of them. Double Play Baseball Tours and its affiliates and representative(s) (collectively, its “Representatives”) are acting solely as intermediaries. Double Play Tours and its Representatives are responsible only for making the arrangements for accommodations, services, and events that constitute the tour package, except to the extent that accommodations or services cannot be supplied due to reasons beyond the control of Double Play Tours or its Representatives, as detailed in these terms and conditions. The carriers, motor coach companies, hotels, and other suppliers, providing travel, hotel, and other accommodations are independent contractors and not agents or employees of Double Play Baseball Tours or its Representatives. Double Play Baseball Tours is not affiliated with MLB, or any professional team or league.
Payment: Double Play Baseball Tours requires a $250 deposit per person at the time of booking in order to make the reservation (the “Deposit”). The final payment is due 90 days prior to the confirmed arrival date. Upon booking a tour package and making the Deposit, Travelers agree to allow Double Play Baseball Tours to charge the card used for the Deposit to satisfy the final payment.
Cancellations and Refunds: Double Play Baseball Tours requires written notification of cancellation pursuant to the provision contained herein. Cancellations 91 days or more prior to confirmed arrival date are eligible for a full refund. Cancellation notifications received 61-90 days prior to confirmed arrival date are subject to a cancellation fee equal to the initial deposit. Cancellations received 31-60 days prior to confirmed arrival date will receive a 50% refund. Cancellations received less than 30 days prior to confirmed arrival date are not eligible for a refund. There shall be no refunds given for any unused travel services or any portion thereof. Double Play Baseball Tours reserves the right to cancel any tour at its discretion. In the event that a tour is cancelled, for reasons other than a Force Majeure Event (below), all Travelers booked on that tour will receive a refund of the Deposit or any other payments made. Travelers may elect to receive the funds as a credit toward a future tour package at their discretion. Double Play Baseball Tours is not responsible for any payments made by the Traveler to other entities such as, airlines, car services, travel agents, etc.
Prices: Prices reflected are per person, based upon the stated single, double, triple, or quadruple occupancy. Prices reflected at the time of booking are in effect at that time only and are subject to change without notice.
Not Included: Air transportation and related fees at the beginning and end of trip; activities noted as optional in the itinerary; gratuities for service not listed as part of the tour, baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, meals and alcoholic beverages; and any other items not specifically noted as included in your travel package. Documentation is the responsibility of each individual traveler to obtain the documentation required for their trip such as, but not limited to, passports, visas, birth certificates, and photo identification. Double Play Baseball Tours is not responsible for any information provided concerning such documentation.
Itineraries: Every effort is made to not deviate from the published itineraries that are presented. In the rare circumstances where a revision is necessary, the company reserves the right to make changes that may include a change in game dates and/or times, tours offered, hotels substituted, or travel methods altered when deemed necessary to do so. All such changes will be communicated to the attendee and any such changes will not result in eligibility for refund. Double Play Baseball Tours also reserves the right to cancel or postpone any scheduled tour, must meet a 8 person minimum for each tour to be in effect, if not a full refund will be given.
Included in Tour Cost: Hotel accommodations as indicated in the itinerary; pre-departure information; entrance fees on included tours, game tickets to listed games; listed excursions and sightseeing as noted in the itinerary; ground transportation during the tour; escorted tour host services of a Double Play guide.
Photography: Double Play Baseball Tours reserves the right to take photographs or videos during the operation of any tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation with Double Play Baseball Tours, the participant agrees to allow his/her likeness to be used by Double Play Tours. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the trip.
Hotel Policy: Incidental hotel charges including room service, laundry, internet service, phone calls, etc. are not covered and are the full responsibility of the participant. Hotels generally require a credit card at check in to cover incidentals and all incidental charges are to be paid directly to the hotel by the participant at check out. Single/Shared Accommodations: A limited number of single hotel rooms are available at a supplemental cost as noted in the price listings. In regards to double, triple, and quadruple occupancy, every effort is made to secure two queens beds or larger at all of our hotel partners. In many circumstances, hotels only offer two double beds per room. Upon acceptance of triple or quadruple occupancy, participants are hereby notified and accept this bedding option.
Health Requirements: You must be in good physical and mental health. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made. All clients shall comply with any prohibition on smoking imposed on any coaches and at any hotels/venues on any tour.
Force Majeure: Double Play Baseball Tours and its Representatives’ performance under this Agreement may be excused by any events or occurrences beyond their control such as, but not limited to, acts of God, war or threat of war, government retaliation against foreign or domestic enemies, terrorism, government regulation or shutdown, executive order, civil disorder, recognized health threats as determined by the World Health Organization, the Centers for Disease Control or local health agency, disaster, fire, strikes either real or threatened, curtailment of transportation facilities, or any other cause beyond the reasonable control of Double Play Baseball Tours or its Representatives, making it from an economic, political, personal safety, or policy basis, illegal, inadvisable, or impossible to perform the tour (a “Force Majeure Event”). Double Play Baseball Tours and its Representatives have no liability and will have no obligation to make a refund if a Force Majeure Event occurs.
Limitation of Liability: In no event will Double Play Baseball Tours be liable to any travelers for any indirect, special, exemplary, incidental, punitive, or consequential damages arising from or relating to any tour or these terms and conditions, even if Double Play Tours knew or should have known of the possibility of such damages. Double Play Baseball Tours total cumulative liability arising from or related to any tour or these terms and conditions, whether in contract or tort or otherwise, will not exceed the amount of fees actually paid to Double Play Baseball Tours by the traveler who brings the claim or alleges the liability. The parties acknowledge that these terms reflect the allocation of risk set forth in this agreement, and that the parties would not enter into this agreement without these limitations of liability. Double Play Baseball Tours and its representatives are not liable for negligence or willful misconduct of any suppliers or third parties providing services on the tour, or for any personal injuries, death, property loss, or other damages resulting therefrom.
Acknowledgement: Travelers hereby agree that each has read and fully understands the Terms, which will serve as a binding contract between Travelers and Double Play Baseball Tours. Double Play Tours reserves the right to change the Terms in its sole discretion, effective upon posting the amended Terms on the Double Play Baseball Tours website, or by communicating any changes to Travelers through written notice, and Travelers agree to accept and be bound by those amended Terms.
